Recently, Huangdao Customs seized one suspected infringing diesel engine in the freight channel. During on-site inspection, customs officers discovered an undeclared diesel engine concealed in the actual goods. Weighing over 1 ton, the engine bears the “WEICHAI” logo with obvious splicing traces on the nameplate.
Since the shipper failed to provide authorization certificates for the relevant trademark, the customs immediately suspended the engine’s customs clearance and initiated customs intellectual property protection measures. Upon on-site confirmation by the right holder, the engine was verified as an infringing product. Currently, the customs has legally detained the engine.
In accordance with the provisions of the “Customs Law of the People’s Republic of China”, the customs legally protects intellectual property rights related to inbound and outbound goods. Those who import or export goods that infringe upon intellectual property rights protected by laws and administrative regulations in violation of relevant provisions shall have the infringing goods confiscated and be fined by the customs; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
